Terms of Service
1. Acceptance
By accessing or using TetraSoft services — including the Atlas data platform and MAES Studio (collectively, "Services") — you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree, do not use the Services.
2. Services
Atlas is a read-only data platform providing emissions, well, pipeline, production, and enforcement data for the oil and gas industry. It is an analytical tool. It is not a real-time monitoring system, an alerting service, or a regulatory compliance filing system.
MAES Studio is a configuration interface for the Mechanistic Air Emissions Simulator, used to build and manage emissions simulation study sheets.
TetraSoft reserves the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
3. Accounts
Access to the Services requires an account. You are responsible for maintaining the confidentiality of your credentials. You must notify TetraSoft immediately at arthur.santos@tetrasoftco.com if you become aware of unauthorized use of your account.
Accounts are non-transferable. One account per individual. Sharing login credentials is not permitted.
4. Acceptable Use
You may use the Services for lawful business and research purposes. The following are prohibited:
- Automated scraping, crawling, or bulk downloading of Atlas data
- Accessing the Services through unauthorized means or attempting to circumvent access controls
- Redistributing, sublicensing, or reselling Atlas data or MAES outputs to third parties without written permission
- Using the Services to develop a competing product
- Uploading malicious files or attempting to disrupt the Services
- Impersonating another user or entity
TetraSoft may terminate accounts that violate these terms without prior notice.
5. Intellectual Property
TetraSoft's IP. The Atlas dataset, data pipeline methodology, MAES simulation engine, and all TetraSoft software are owned exclusively by TetraSoft LLC. Your access to the Services does not transfer any ownership or license beyond the right to use the Services as described here.
Your data. Gas composition files and other data you upload to MAES Studio remain your property. You grant TetraSoft a limited license to process that data solely to deliver the Services to you. TetraSoft will not share your uploaded data with third parties.
Outputs. MAES study sheets generated from your inputs may be used by you for internal business purposes. Outputs may not be published or redistributed in a way that implies TetraSoft has endorsed or validated them, without written permission.
6. Data Accuracy
Atlas data is sourced from public regulatory filings (Colorado ECMC/ONGAEIR, Texas RRC). TetraSoft processes and normalizes this data but does not guarantee its accuracy, completeness, or timeliness. Regulatory data has known limitations: it does not capture failure-mode emissions, may contain operator reporting errors, and may lag behind current conditions.
Atlas is an analytical tool for research and due diligence. It is not a substitute for field measurement, certified regulatory reporting, or legal advice. Do not use Atlas outputs as the sole basis for compliance filings or enforcement decisions.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TETRASOFT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TETRASOFT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TETRASOFT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
TETRASOFT IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Termination
Either party may terminate these Terms at any time. TetraSoft may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Services ends. Sections 5, 7, 8, and 10 survive termination.
10. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes will be resolved in the courts of Larimer County, Colorado.
11. Changes to These Terms
TetraSoft may update these Terms. When we make material changes, we will update the effective date above and notify active users by email. Continued use of the Services after notice constitutes acceptance of the updated Terms.
